I have a MacBook Pro Retina with OS X 10.8.5 and I do not see any sw update available

The OS has been updated as far as it will go. If you haven't downloaded 10.9, 10.10, 10.11 or 10.12 yet, you no longer can. If you want to upgrade to High Sierra, the newest OS just released today, and your machine meets HS's requirements, go to the Apple menu > App Store > type in the search field in the upper right corner "macOS High Sierra" and you'll be presented with a search result to download HS.

If you're going to upgrade, make sure to backup first.
