i want to load all of the photos from my iPhone...

I have my phone backup to my iCloud account and there is still almost 3 gig worth of photos in my photo library on my phone that will not transfer to my iCloud, I need the space to in stall updates

You cannot do that with iCloud.  iCloud photo library is a synchronization service only, not a backup or archival storage.  Anything you put up in your iCloud photo library must also be kept on every device you sync that library with.  if you delete a photo on the phone, it will delete it from iCloud and every device sync'd via your iCloud account.

You can archive your photos on your computer - e.g. the Photo's app in OS X, or you can use on online archive service like dropbox or google.
