Secondhand ipod touch 5th generation updated to...

The person I purchased this iPod from has passed away and I do not know the original Apple ID he used to activate the iPod.. what can I do to fix this? Otherwise I will lose a lot of photos that are very important to me. I appreciate any help. 

You would need to obtain proof that the original owner passed away, take it and the device to Apple or call them, and ask them to remove the Activation Lock.
