MacBook uninstalled osx

So I have a 2012 model MacBook Pro and I know it has problems. It had been diagnosed around 2 weeks ago with needing a new hard drive but I will be receiving a new MacBook when I can afford it in a few weeks. Today with no warning from a restart, it appears to have erased the entire osx software and every single thing on the MacBook. I have all my contents backed up however, it won't even let me download the software again so I can recover my back up. Apparently my software help has also run out so paying 39$ per call is not ideal, help! 

You knew that the hard drive was bad, and a complete drive failure should come as no real surprise. A phone call is not going to resolve that failed drive issue. Providing you do not change your user id, or computer name on the new Mac setup, you should be able to recover from your backup.
