You, my friend, have a 1st generation iPod, so there is no way for you to update it.
What generation is the iPod? If it's 3rd or 4th, you can update it. (to iOS 5).

It sounds like you have an originalipod toouch.
What version ios do you have now?
3.1 is the latest vailable for the original ipod touch.
I'm not sure what Generation it is. I only know what I can read on the back. It says Model #A1213 and has a (C) date of 2007. Does that help or is there some other way of telling?

Go to Settings > General > About > Serial Number.
Enter your serial number here: https://apple.com/support/specs/

You, my friend, have a 1st generation iPod, so there is no way for you to update it.
Then have a 1st generation and that is indeed the latest version
So pretty much this ipod is useless because it is 5 years old?
It is in no way useless, you can use it the same as you have been. 5 years is a lot when talking about mobile technology, the hardware cannot support the latest software.
I experience the same problems with my iPhone 2G (original), which also can only be updated to 3.1.3. However I also have an iPhone 4S so that can update and I don't have a problem since it's brand new.
For the iPod touch, you would need a 3rd or 4th generation to work with iOS 5. I would recommend a 4th generation because it would probably be more compatible with future updates.
Thanks everyone for the help. I've been trying to figure it out for 2 days. I'm not the most Tech savy guy in the world. haha. I guess I can keep playing checkers seeings how i cant download any new apps.
I am surely not going to go out and spend hundreds for something that will be way outdated the next week. HAHA. The only reason I have an Ipod is because it was given to me second hand. I guess its a good thing i have better things to do than play Ipod anyways.
oh okay i cant even get fb i had it before ??
The latest version wouldn't be compatible, if you attempted to update or download from the App Store then it won't work
