Junk folder not recognised in Apple mail

I have a Junk folder visible in i mail, but when I received a junk mail today and marked it as junk it returned a window saying junk mail does not exist and says its null and void.

I have went into settings and unchecked the enable junk mail filtering and checked again, I just don't seem to be able to move a mail message to the junk folder.

How do I restore the junk folder or should I just be deleting the junk mail.
