Then it sounds like the device was not wiped before you got it. Apps that have been downloaded/purchased are permanently locked to the Apple ID used to download/purchase them. The only way to get past that is to delete the apps in question, and if you need them, download them again with your Apple ID. I'm guessing, but your Apple ID is the one used to log into the App Store and iTunes, correct?

Heya. No there was nothing on it at all when we changed over he took his apple I.D and all his accounts off it was tottally empty

If the previous owner properly prepared the phone BEFORE they sold it to you, then there should be NO residual Apple IDs on the phone or anything else to tie them to it.
