Smart Playlist not working when pointing to ano...

I have a large number of static playlists and have been trying to use smart playlists to group them together.  I have done this by creating a smart playlist with the following settings:

ticking match music for any of the following rules:

Playlist is "Rock Pop Great"

Playlist is "Rock Pop Oldies"

with live updating ticked.

Creating the smart playlist works however I get a cloud icon next to the playlist name with a cross through it.  If I click the cloud icon I get the following error

The playlist "Car Rock Pop" can't be added to your iCloud Music Library.

iCloud Music Library playlists can only include music from your iCloud Music Library.  The playlist can't be uploaded because it includes other media kinds or songs that are not eligible.

Also the new smart playlist won't appear on my ios devices .  This is odd as it is just music in the static lists and I am subscribed to iMatch and Apple Music.

I therefore tried an experiment.  I created a new static list called "Test" and downloaded a single track locally in the "Test" playlist.  I then created a smart list called "Test2" and set the following

Playlist is "Test"

and had the same problem.  Any suggestions?
