duplicate Macintosh HD in download folder

This is a two part question. I am running a MacPro 2008 system with OS X El Capitan 10.11.6 system.

I noticed in my Downloads folder there is a duplicate "Macintosh HD" Local Volume. Why is this here and how can I delete it. If I am ok to delete it?

My second question. (Which I'm not sure if this is related to my above question or not.) But when I try to move or delete other files. I get an error, "“Trash” can’t be opened right now because it’s being used by another task, such as moving or copying an item or emptying the Trash. Try again when the current task is complete." There is nothing running, copying or pasting for this error to be happening.

Any help?
